TERMS AND CONDITIONS

These Terms and Conditions govern the use of Credit Fix JOE services, website, client portal access, communications, consultations, billing, credit education, credit analysis, dispute preparation, and related services.

By using this website, enrolling in services, submitting information, signing an agreement, communicating with Credit Fix JOE, or accessing any client resources, you agree to these Terms and Conditions, our Privacy Policy, and any signed client service agreement applicable to your services.

Credit Fix JOE is a small local family based business providing lawful, compliance-based credit consultation, credit education, credit profile review, and dispute strategy services.

SERVICES PROVIDED

Credit Fix JOE provides credit consultation, credit profile review, credit education, credit strategy, dispute preparation, dispute sequencing, progress tracking, credit optimization guidance, and related services designed to assist clients in reviewing, organizing, and addressing their credit profiles through lawful and compliance-based methods.

 

Services may include, where applicable:

• Credit file review and analysis
• Review of information appearing on consumer credit reports
• Identification of potentially inaccurate, obsolete, incomplete, unverifiable, or questionable information
• Strategic dispute planning
• Bureau dispute preparation
• Furnisher dispute preparation
• Method of Verification requests
• Escalation-based dispute sequencing
• Collection account review and strategy
• Inquiry review and dispute preparation where applicable
• Credit profile optimization guidance
• Client education and progress tracking
• Review of credit monitoring information
• Client support and consultation

Credit Fix JOE does not provide legal advice, tax advice, accounting advice, mortgage approval decisions, lending decisions, investment advice, or debt settlement services.

NO GUARANTEE OF RESULTS

Credit Fix JOE does not guarantee any specific credit score increase, deletion result, approval decision, funding result, loan result, tradeline removal, collection removal, inquiry removal, reporting change, or timeframe.

Results vary based on each client’s unique credit profile, creditor and furnisher reporting practices, credit bureau investigation procedures, the legal verifiability of reported information, client participation, documentation quality, account history, debt obligations, current credit behavior, and many other factors outside the control of Credit Fix JOE.

Accurate, timely, and verifiable information cannot legally be removed simply because a client wants it removed.

Credit Fix JOE only assists with lawful, compliance-based review and dispute processes.

CLIENT RESPONSIBILITIES

Clients are responsible for providing accurate, current, and complete information throughout the service relationship.

Clients agree to:

• Provide clear identification documents when requested
• Provide acceptable proof of address when requested
• Maintain active required credit monitoring access
• Keep payment information current
• Forward important creditor, collector, or bureau correspondence within five (5) business days
• Avoid applying for new credit without discussing strategy first
• Avoid significantly increasing balances during active services
• Communicate truthfully and promptly
• Respond to reasonable requests for documentation or clarification
• Notify Credit Fix JOE of any material changes affecting their credit profile
• Avoid taking actions that may interfere with active strategy or dispute sequencing

Client cooperation is essential. Failure to participate, provide documentation, maintain monitoring, maintain payment status, or communicate may delay or interrupt services.

CREDIT MONITORING REQUIREMENT

Active third-party credit monitoring access is required during participation in services.

Credit monitoring allows Credit Fix JOE to review credit profile changes, track updates, review bureau reporting, analyze results, and support dispute strategy.

If using Credit Hero Score, enrollment occurs after signup and is billed separately through the monitoring provider.

Credit Hero Score or any other third-party monitoring provider is separate from Credit Fix JOE unless otherwise stated.

Failure to maintain active monitoring access may interrupt active workflows, delay dispute sequencing, delay progress reviews, prevent updated report analysis, or temporarily suspend strategic activity until access is restored.

If required monitoring services, including Credit Hero Score or equivalent monitoring access, become inactive, suspended, canceled, inaccessible, or unpaid for more than five (5) business days, Credit Fix JOE reserves the right to charge a non-refundable $19 account reactivation and workflow restoration fee prior to resuming services.

Credit Fix JOE shall not be responsible for delays caused by inactive monitoring access, failed monitoring payments, expired monitoring payment methods, third-party monitoring outages, client-caused interruptions, or inaccessible monitoring accounts.

THIRD-PARTY SERVICES

Certain services may require the use of third-party platforms, software, credit monitoring systems, payment processors, communication platforms, portals, or affiliated service providers.

Third-party services may include, but are not limited to, credit monitoring providers, client portals, payment processors, electronic signature providers, communication tools, and credit report access tools.

Credit Fix JOE is not responsible for outages, interruptions, pricing changes, billing issues, reporting delays, data limitations, access restrictions, or service limitations caused by third-party providers.

Clients remain responsible for maintaining any required third-party account access needed for Credit Fix JOE to perform services.

PAYMENT AGREEMENT AND BILLING AUTHORIZATION

By enrolling in services, signing a client agreement, submitting payment information, or authorizing payment, the client authorizes Credit Fix JOE to charge the payment method provided for applicable enrollment fees, recurring monthly service fees, administrative fees, reactivation fees, and any other authorized amounts associated with services.

 

THE ELITE RESOLUTION PLAN

Enrollment Fee:
$199.99 authorized at signup and processed one (1) business day later. Funds are held in a designated trust account and are not considered earned until the initial contracted services and work commencement obligations have been completed in accordance with applicable federal and state law.

 

Monthly Service Fee:
$199.99 recurring every thirty (30) days following completion of the initial work commencement phase and continuing every thirty (30) days thereafter unless canceled.

Billing may continue every thirty (30) days until the client cancels in writing or services are otherwise terminated.

Credit Fix JOE may update pricing, plan structure, services, or billing policies from time to time. Existing clients will be subject to the terms of their signed agreement unless otherwise updated by written agreement or lawful notice.

MONTH-TO-MONTH SERVICE

Credit Fix JOE services are month-to-month unless otherwise stated in a signed written agreement.

There is no long-term contract obligation.

Clients may cancel at any time by submitting written notice via email to: info@creditfixjoe.com

Cancellation should be submitted prior to the next scheduled billing date to avoid additional recurring charges.

No partial refunds shall be issued for billing periods that have already begun, except where required by applicable law or stated in a signed agreement.

Advanced Creditor Intervention Services

Standard monthly service does not include extensive creditor intervention, debt settlement negotiation assistance, conference calls, CFPB follow-up communication, or manual creditor account resolution services.

When requested by the client, these advanced services may be billed separately at a rate of $100 per hour, billed in 30-minute increments with a 30-minute minimum charge.

 

Charges apply only to actual time spent on:
• Creditor and collector phone calls
• Settlement discussion assistance
• CFPB follow-up handling
• Three-way client/lender calls
• Manual account research and intervention
• Documentation and case management related to negotiated resolutions

Client authorization may be obtained verbally, electronically, or in writing prior to work being performed.

Credit Fix JOE provides administrative support and credit education services only. Results are not guaranteed, and no legal representation is provided.

FAILED PAYMENTS AND ADMINISTRATIVE FEES

Clients are responsible for maintaining valid and current payment information throughout the duration of services.

A three (3) calendar day grace period may be provided for failed or declined payments before any administrative fee is assessed.

If a scheduled payment is declined, returned, disputed, reversed, or otherwise unsuccessful beyond the applicable grace period, Credit Fix JOE reserves the right to charge a non-refundable $25 administrative processing fee to offset additional account handling, billing review, workflow interruption, and manual administrative services associated with the failed transaction.

Credit Fix JOE may provide one (1) courtesy waiver of such administrative fee per client lifetime at its sole discretion.

Accounts with unresolved balances, failed payments, disputed payments, chargebacks, expired payment methods, insufficient funds, or unpaid recurring service fees may be temporarily paused until the account is brought current.

Credit Fix JOE shall not be responsible for delays in service execution caused by failed payments, expired payment methods, insufficient funds, unresolved billing issues, chargebacks, or client-caused payment interruptions.

SERVICE PAUSE, INTERRUPTION, OR TERMINATION

Credit Fix JOE reserves the right to pause, limit, decline, suspend, or discontinue services for accounts that are:

• Delinquent
• Inactive
• Unresponsive
• Abusive
• Fraudulent
• Subject to unresolved chargebacks
• Missing required documentation
• Missing active credit monitoring
• Using inaccurate or misleading information
• Materially non-compliant with required program participation
• Disruptive to lawful operations
• Outside the scope of services Credit Fix JOE is able or willing to provide

Service pauses may delay dispute sequencing, progress reviews, correspondence preparation, escalation timelines, and other workflow activity.

Credit Fix JOE is not responsible for delays caused by client non-participation, missing documentation, inactive monitoring, billing failure, third-party interruption, or client-caused workflow disruption.

REFUND POLICY

Refunds may be available within the first five (5) business days following signup in accordance with applicable Washington and Idaho consumer protection considerations and the client’s signed agreement.

If a client timely cancels during an applicable cancellation period and payment has been made, Credit Fix JOE will process any required refund in accordance with applicable law.

No partial refunds are issued for billing periods that have already begun unless required by law or expressly stated in a signed agreement.

Administrative fees, failed payment fees, reactivation fees, and third-party provider fees may be non-refundable unless required by law.

RIGHT OF CANCELLATION

Clients may cancel their client service agreement without penalty or obligation by midnight of the fifth (5th) business day after signing by providing written notice to: info@creditfixjoe.com

This five (5) business day cancellation period is intended to satisfy or exceed applicable cancellation protections where required.

Cancellation after the initial cancellation period will stop future recurring billing but does not automatically create a refund for billing periods that have already begun.

CONSUMER CREDIT FILE RIGHTS

Consumers have the right to dispute inaccurate information in their credit report by contacting the credit bureaus directly.

Consumers may obtain a free copy of their credit report from each credit bureau annually.

Credit bureaus must follow reasonable procedures to assure maximum possible accuracy of consumer report information.

Credit bureaus must investigate disputed items free of charge and must allow consumers to include statements if disputes are not resolved.

Only inaccurate, obsolete, incomplete, or unverifiable information may be challenged or removed through lawful credit reporting processes.

Accurate and verifiable information cannot legally be removed simply because a consumer wants it removed.

Consumers may sue a credit repair organization that violates applicable law.

CROA AND STATE LAW COMPLIANCE

Credit Fix JOE operates with the intent to comply with applicable federal and state laws, including but not limited to:

• Credit Repair Organizations Act
• Fair Credit Reporting Act
• Fair Credit Billing Act where applicable
• Electronic Signatures in Global and National Commerce Act
• Applicable Washington consumer protection and credit services organization requirements
• Applicable Idaho consumer finance, licensing, and credit repair organization requirements where applicable

Nothing in these Terms is intended to waive or limit any non-waivable consumer rights under federal or state law.

If any provision of these Terms conflicts with a mandatory consumer protection law, the mandatory law controls.

WASHINGTON DISCLOSURE

For Washington consumers, Credit Fix JOE recognizes applicable Washington credit services organization requirements, including cancellation rights and consumer protections under Washington law.

Washington consumers may have the right to cancel a credit services organization contract without penalty or obligation within five (5) working days after signing.

If cancellation is timely submitted within the applicable cancellation period, required refunds will be handled in accordance with Washington law.

Washington consumers retain all rights provided under applicable Washington consumer protection laws.

IDAHO DISCLOSURE

For Idaho consumers, Credit Fix JOE recognizes applicable Idaho requirements governing credit repair organizations, licensing, bonding, records, and consumer protection obligations under Idaho law where applicable.

Credit Fix JOE does not intend to operate in Idaho in violation of applicable licensing, bonding, or consumer protection requirements.

Idaho consumers retain all rights provided under applicable Idaho and federal law.

COMMUNICATION CONSENT

By using this website, submitting forms, scheduling appointments, enrolling in services, or communicating with Credit Fix JOE, you consent to receive service-related communications from Credit Fix JOE.

• Emails
• Phone calls
• Text messages
• Appointment reminders
• Billing notifications
• Payment alerts
• Client portal updates
• Workflow updates
• Account alerts
• Educational information
• Service-related follow-up

Message and data rates may apply.

Consent to receive marketing messages is not required as a condition of purchase.

PRIVACY POLICY

Credit Fix JOE’s Privacy Policy is incorporated into these Terms by reference.

LIMITATION OF LIABILITY

To the maximum extent permitted by law, Credit Fix JOE shall not be liable for indirect, incidental, consequential, special, punitive, exemplary, or speculative damages arising from or related to services, website use, credit reporting delays, bureau decisions, creditor actions, collection agency actions, third-party interruptions, payment issues, client financial decisions, lending outcomes, score changes, or service delays.

Nothing in this section limits non-waivable rights under applicable consumer protection laws.

GOVERNING LAW

These Terms shall be governed by the laws of the State of Washington, unless another state’s mandatory consumer protection law applies.

To the extent legally permitted, any dispute relating to these Terms, website use, or services shall be brought in Spokane County, Washington.

Nothing in this section limits any mandatory consumer rights or venue rights that cannot be waived under applicable law.
